FlowGrow Terms & Conditions

1. Introduction

Welcome to FlowGrow (“we”, “us”, “our”). These Terms & Conditions apply to your use of our website and the purchase of products from flowgrow.co.nz.

By using our website or purchasing from FlowGrow, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand consumer law.

2. Products & Intended Use

FlowGrow hydroponic tower systems are intended for residential home growing use unless otherwise stated.

Successful growing depends on several factors, including:

• Adequate natural light or a well-lit sheltered outdoor space
• Correct assembly and safe operation
• Regular water top-ups and basic maintenance
• Correct nutrient mixing and pump care
• Plant type, season, temperature, and growing conditions

Plant growth outcomes vary depending on environment, plant choice, light exposure, and user care. FlowGrow does not guarantee specific crop yields or growing results.

3. Pricing & Payment

All prices are listed in New Zealand Dollars (NZD) and include GST unless stated otherwise.

We reserve the right to update pricing, correct pricing errors, or cancel orders affected by pricing, stock, or product listing inaccuracies.

Payment must be received before goods are dispatched.

4. Payment Providers

FlowGrow may offer payment through third-party payment providers, including Shopify Payments, Shop Pay, Afterpay, or other available payment options at checkout.

When you choose a third-party payment provider, you may also be subject to that provider’s own terms, conditions, approval process, fees, and payment policies.

FlowGrow is not responsible for third-party payment approvals, declined transactions, late fees, or payment disputes managed by those providers.

5. Pre-Orders

Some products may be offered on a pre-order basis.

By placing a pre-order, you acknowledge that:

• Estimated delivery timeframes will be stated on the product page where possible
• Delays may occur due to supply, manufacturing, freight, or customs factors
• Full payment, or approval through your chosen payment provider, may be required at the time of order

If significant delays occur, we will notify you and provide options in line with New Zealand consumer law.

6. Subscriptions

FlowGrow may offer recurring subscription products in the future, such as nutrients or consumables.

If subscriptions are available and you choose to subscribe, you authorise recurring billing at the selected interval until the subscription is cancelled or changed.

You may cancel or modify your subscription through the available account tools or by contacting us before the next billing cycle.

Subscription changes or cancellations do not apply retroactively to payments that have already been processed.

FlowGrow reserves the right to adjust subscription pricing or availability with reasonable notice.

7. Spare Parts & Replacement Components

Spare parts and replacement components are intended for use with compatible FlowGrow systems only.

FlowGrow is not responsible for damage or issues caused by:

• Incorrect installation
• Use with non-compatible systems
• Modification of parts or tower components
• Improper fitting, handling, or maintenance

If you are unsure whether a part is suitable for your FlowGrow system, please contact us before purchasing.

8. Shipping & Delivery

FlowGrow currently ships within New Zealand only.

Free NZ-wide shipping applies to FlowGrow towers and tower starter bundles.

Standard NZ shipping applies to standalone nutrients, starter kits, accessories, growing essentials, and replacement parts. Shipping will be shown at checkout before you complete your order.

Shipping timeframes are estimates only. Courier delays, rural delivery timeframes, weather events, public holidays, and other factors outside our control may affect delivery.

If your order appears delayed or lost, please contact us and we will help lodge an enquiry with the courier where appropriate.

If goods arrive damaged, please notify us within 48 hours of delivery and provide clear photographs of the packaging and damage where possible.

9. Warranty & Returns

FlowGrow products are covered by the protections provided under New Zealand consumer law, including the Consumer Guarantees Act 1993.

FlowGrow may also offer product-specific warranty information for certain items, including tower systems and components.

Warranty coverage does not apply to damage or issues caused by misuse, incorrect assembly, lack of maintenance, unauthorised modification, incorrect nutrient mixing, unsuitable growing conditions, or failure to follow supplied instructions.

10. Commercial Use

FlowGrow products are primarily intended for residential home use.

If products are purchased for business or commercial purposes, some consumer protections may not apply where legally permitted under New Zealand law.

11. Limitation of Liability

To the maximum extent permitted by law, FlowGrow is not liable for indirect, incidental, or consequential loss, including but not limited to:

• Loss of crops due to environmental conditions
• Plant failure caused by unsuitable light, temperature, water quality, or plant choice
• Damage caused by misuse, incorrect assembly, or failure to follow instructions
• Issues caused by improper nutrient mixing, pump operation, or lack of maintenance

This clause does not limit your rights under the Consumer Guarantees Act 1993 or any other applicable New Zealand consumer law.

12. Intellectual Property

All website content, branding, product names, guides, manuals, imagery, written materials, and other content remain the intellectual property of FlowGrow unless otherwise stated.

Unauthorised reproduction, copying, distribution, or commercial use is prohibited.

13. Website Use

You agree not to:

• Use the website for unlawful purposes
• Interfere with website security or functionality
• Copy, reproduce, or redistribute website content without permission
• Attempt to access systems, data, or areas of the website without authorisation

14. Privacy

We collect and process personal information in accordance with our Privacy Policy.

New Zealand privacy obligations are governed by the Privacy Act 2020, which covers how personal information is collected, used, stored, and disclosed.

15. Changes to Terms

FlowGrow may update these Terms & Conditions from time to time. The most current version will be available on our website.
